Council is seeking community comment on a Planning Proposal to list the Macquarie Ice Rink at 197-223 Herring Road, Macquarie Park as a local heritage item under the Ryde Local Environmental Plan 2014 (RLEP). 

Responding to concerns about the possible removal of the rink, Council resolved to place an Interim Heritage Order on the site and commissioned an assessment against the relevant heritage listing criteria. 

The assessment commissioned by Council found that the site met the criteria for listing and Council subsequently resolved to proceed with the process to list the rink as a local heritage item. 

The Environmental Planning and Assessment Act 1979 (planning legislation) sets out the process that must be followed to list a local heritage item. The process requires Council to prepare a Planning Proposal that provides information and a justification for the proposed listing; that the Planning Proposal is to be publicly exhibited; and any comments and submissions are considered by Council before finalising. Prior to exhibiting the proposal, a “Gateway Determination” is required from the State Government. This has been issued to Council, allowing Council to undertake the necessary public exhibition period.

The Planning Proposal will be on public exhibition from 16 November 2020 to 16 December 2020.  

Council has been authorised as the local plan making authority by the Department of Planning, Industry and Environment. This means that following exhibition of the Planning Proposal, Council may determine to proceed with the listing, not proceed with it or to defer its decision. 

Council has also been working with AMP Capital, the owners of the site, to retain a rink on the site as part of the site’s proposed redevelopment. The proposed redevelopment is subject to a separate process; however, AMP has been working with Council to ensure the heritage significance of the rink is appropriately managed via the provision of an appropriately upgraded rink within the redevelopment. The Development Application for the redevelopment has been exhibited separately.

During the public exhibition period any community member, stakeholder or government agency can provide feedback on the Planning Proposal by lodging a submission with Council. A submission can include any comments or concerns relating to the exhibition material and proposed local heritage listing. Submissions must also include a declaration regarding the following:

In accordance with s10.4 of the Environmental Planning and Assessment Act 1979, a person who makes a public submission to a council is required to disclose the following reportable political donations and gifts (if any) made by the person making the submission or any associate of that person within the period commencing 2 years before the submission is made and ending when the application is determined—

(a)  all reportable political donations made to any local councillor of that council,

(b)  all gifts made to any local councillor or employee of that council.
