The City of Ryde Council (Council) has prepared a draft Local Housing Strategy (LHS) that sets out a plan to manage growth and the delivery of new housing across the Ryde area for the next 10-20 years.
The draft LHS found that the introduction of the Low Rise Housing Diversity Code (Codes SEPP) on 1 July 2020 has the potential to undermine the local character and amenity of the R2 Low Density Residential zone.
In response, Council has also prepared a draft Planning Proposal to amend the planning controls (Ryde Local Environmental Plan 2014 (LEP 2014)) for the R2 Low Density Residential Zone of the Ryde Local Government Area (LGA), which proposes to remove Multi Dwelling Housing as a permitted use in the R2 zone and to amend the planning controls that apply to Dual Occupancy development.
Council is exhibiting the draft Ryde Local Housing Strategy (LHS) and associated Planning Proposal from Friday 16 October to Monday 16 November 2020.
WHAT ARE THE PROPOSED CHANGES?
The current controls, and the proposed changes relating to the R2 Low Density Residential zone, are shown in the table below. Please note that the changes are not retrospective, approved developments will not be affected by the proposed changes; the changes would only apply to future applications.

Notes:
- Dual occupancy (attached) means 2 dwellings on one lot of land that are attached to each other, but does not include a secondary dwelling (such as a Granny Flat).
- Multi dwelling housing means 3 or more dwellings (whether attached or detached) on one lot of land, each with access at ground level (such as a villa or townhouse), but does not include a residential flat building.
The Environmental Planning and Assessment Act 1979 (planning legislation) sets out a process that must be followed to make these changes. The process requires:
a) Council to prepare a Planning Proposal that provides information and justification for the proposed changes;
b) The Planning Proposal is to be publicly exhibited upon approval from the Department of Planning, Industry and Environment and;
c) Any comments and submissions are to be considered before finalising.
The Planning Proposal then requires Council and the NSW State Government approval prior to coming into force.
The NSW Department of Planning, Industry and Environment as a delegate of the Minister for Planning and Public Spaces have issued a Gateway Determination enabling the proposed changes to Council’s Local Environmental Plan (Planning Proposal) to be publicly exhibited under section 3.34(2) of the Environmental Planning and Assessment Act.
Council has not been given delegation to finalise the Planning Proposal. The results of this community consultation will be reported to Council and Council’s recommendation will be forwarded to the Minister and the Department of Planning, Industry and Environment requesting that they finalise the LEP amendment.
The draft Local Housing Strategy, Planning Proposal and related explanatory material will be on public exhibition from Friday 16 October to Monday 16 November 2020.

During the public exhibition period any community member, stakeholder or government agency can provide feedback on the draft LHS and/or draft Planning Proposal by lodging a submission with Council. A submission can include any comments or concerns relating to the exhibition material and proposed changes to the planning controls. Submissions must also include a declaration disclosing any reportable political donations and gifts in accordance with the following:
In accordance with s10.4 of the Environmental Planning and Assessment Act 1979, a person who makes a public submission to a council is required to disclose the following reportable political donations and gifts (if any) made by the person making the submission or any associate of that person within the period commencing 2 years before the submission is made and ending when the application is determined—
(a) all reportable political donations made to any local councillor of that council,
(b) all gifts made to any local councillor or employee of that council.

All submissions must be received by Council by 4.00pm on Monday 16 November 2020.
All submissions will be reviewed and considered before a decision is made on the draft LHS or draft Planning Proposal. The outcome of the public exhibition and a summary of the key matters raised (along with a response to the issues raised) will be reported to Council. Where contact details have been provided with submissions, each person who makes a submission will be notified when the draft LHS and Planning Proposal will be reported to Council.
A formal, open meeting of the Council will make the decision on the final Local Housing Strategy and if Council supports finalising the Planning Proposal, it will be sent to the Minister requesting to make the plan.
